Most artists who bother to do a proper ToS point out that they retain copyright and only sell limited use -- the commissioner isn't allowed to sell the image for profit, for instance, and the artist can post and reuse the art however they want. If you want full rights or just don't want it shown by the artist, it's extra.

Without a ToS it probably depends on which jurisdiction you and the artist (primarily the artist) live in, but I think the result is roughly the same.
